A Penalty Charge Notice (PCN) is a type of parking ticket issued by private companies on private land, typically for parking violations such as overstaying or parking in a restricted area. The enforcement of PCNs on private land in the UK depends on various factors, including the terms and conditions of the parking contract between the landowner and the private company, as well as the legality of the parking signs and markings.
In general, private parking companies have no legal authority to issue fines, but they can issue PCNs, which are essentially invoices for breach of contract. If the PCN is issued in accordance with the terms and conditions of the contract, and if the signage is clear and conspicuous, then the PCN can be enforceable. However, private companies must follow a strict set of guidelines set out in the British Parking Association’s Code of Practice, and failure to do so could make the PCN unenforceable.
If you receive a PCN on private land, you should carefully review the terms and conditions of the parking contract, as well as the legality of the signage and markings. If you believe that the PCN has been issued incorrectly or unfairly, you may be able to appeal the ticket through the private company’s appeals process, or through an independent appeals service such as the Parking on Private Land Appeals (POPLA) or the Independent Appeals Service (IAS).
